| On August 8, 2005, President Bush signed the Energy Policy Act of 2005. Title XV, Subtitle B of this act (titled the Underground Storage Tank Compliance Act) contains amendments to Subtitle I of the Solid Waste Disposal Act – the original legislation that created the underground storage tank (UST) program. These amendments significantly affect federal and state underground storage tank programs, will require major changes to the programs, and are aimed at reducing underground storage tank releases to our environment. The amendments focus on preventing releases. Among other things, they expand eligible uses of the Leaking Underground Storage Tank (LUST) Trust Fund and include provisions regarding inspections, operator training, delivery prohibition, secondary containment and financial responsibility, and cleanup of releases that contain oxygenated fuel additives. Colorado does not provide training but allows ICC certification or another state- approved method. All operators must be trained and certified program by 12/31/2009. Trained A or B operators must also perform monthly and annual inspections. Tank Management Services, Inc. (TMS), in coordination with Williams and Company Consulting, Inc., (WCC), has developed a classroom training program that will help UST owners comply with the requirements in the 2005 Energy Policy Act. The classroom training will be specific for three classes of operators: • Level A - Persons having primary responsibility for on-site operation and maintenance of underground storage tank systems; • Level B - Persons having daily on-site responsibility for the operation and maintenance of underground storage tank systems; and • Level C - Daily, on-site employees having primary responsibility for addressing emergencies presented by a spill or release from an underground storage tank system. Training courses will be conducted by certified instructors who have 10 to 30 years of experience in the consulting business. The background knowledge and experience of the instructors include environmental consulting in emergency responses, petroleum release remediation, legal experience seeking subrogation from responsible parties and petroleum storage and dispensing equipment knowledge.
